Hamburg Detains Mentally Ill Individuals Due to Capacity Shortages
Hamburg, March 4, 2026 – Hamburg continues to place individuals in pre-trial detention who, due to severe mental illnesses, are likely to be deemed not criminally responsible. This practice, which contradicts legal requirements, has been highlighted in a Senate response to a CDU inquiry obtained by NDR.
German law dictates that individuals accused of serious crimes, but who are likely to be found not criminally responsible due to mental illness, should initially be housed in the closed ward of a psychiatric hospital, not in pre-trial detention.
Overburdened System: 18 Mentally Ill Individuals in Pre-Trial Detention
However, for years, there has been a critical shortage of beds in these specialized facilities. According to current figures from the Hamburg Senate, 18 mentally ill individuals are currently being held in pre-trial detention, some for over six months. The situation is further exacerbated by the overcrowding of the forensic psychiatric treatment system for mentally ill offenders after court proceedings. The 375 available places are currently occupied by 425 patients, indicating a significant overcapacity.
Richard Seelmaecker, a CDU Member of Parliament, described the situation as “untenable.” He has urged the Senator for Social Affairs to take immediate action and substantially increase capacities within the system.
Social Authority Acknowledges Criticism and Explores Solutions
The Social Authority acknowledges the criticism and, in response to an NDR inquiry, stated its aim to expand clinical capacities for forensic psychiatric placement to meet demand. To achieve this, the authority is “continuously examining options for the use of suitable areas and buildings.”
Furthermore, the authority is working to “further expand capacities in forensic psychiatry at the Asklepios Klinik Nord – Ochsenzoll site within the scope of possibilities.” An expansion of 16 additional beds is reportedly already in the implementation phase.
Rising Numbers of Mentally Ill Offenders
The number of mentally ill offenders requiring placement in Hamburg’s forensic psychiatric system is significantly increasing. Experts view this development with great concern, highlighting the urgent need for comprehensive solutions to address the growing demand and ensure appropriate care for these vulnerable individuals.
