He therefore advised withdrawing the lawsuit, as its main points were unlikely to succeed. However, the residents rejected this advice, meaning the court will issue a judgment.

Court’s Preliminary Assessment Favors Developer

The judgment is not expected to be in favor of the plaintiffs; rather, the court is unlikely to hinder Münchner Wohnen’s construction project on the Mittlerer Ring. If this occurs, the municipal housing association could begin demolishing the five existing cross-buildings at Garmischer Straße 206 to 228 as planned in early 2028. These buildings, constructed in the mid-1950s, are now in poor condition, with some already uninhabited, evidenced by boarded-up windows. Münchner Wohnen’s plans involve replacing them with two U-shaped buildings containing approximately 150 apartments on the extensive property. These new structures would be six and five stories high along Garmischer Straße, with their side wings reaching three stories.

The three-story side wings, at a height of ten meters, would be approximately 16 meters from the plaintiffs’ house, while the 20-meter-high buildings along Garmischer Straße would be 35 meters away. Judge Beil emphasized that both distances are “miles away” from the legally permissible limits. Accordingly, the residents’ lawsuit, which challenges a preliminary approval from the City of Munich for the construction project, has no chance of success regarding a potential violation of neighboring rights.

Commercial Use in Residential Area Deemed Unlawful

However, the situation differs concerning Münchner Wohnen’s plans to include an ice cream parlor, a bakery, and the property management offices on the ground floor of the new buildings, the judge explained. The city council had also approved this in its preliminary decision, which the judge deemed unlawful. Such use, he argued, does not fit into the surrounding area, which is a purely residential zone without commercial establishments. Even if the lawsuit were to succeed on this point, the judge warned it could prove to be a “Pyrrhic victory.” “Simply because it is easy for the city to grant exemptions for these types of uses.”

Josef Beil concluded that the residents would not achieve their actual goal of preventing or reducing the dimension of the planned development through this route. He therefore recommended they withdraw the lawsuit for cost reasons. However, the residents did not follow this advice, so the chamber will now issue a judgment in the coming days.
