Hamburg Pushes for Extended Statute of Limitations in Sexual Offenses

Hamburg, May 3 – Hamburg’s Justice Senator Anna Gallina (Greens) is advocating for a longer statute of limitations for serious sexual offenses. The goal is to strengthen victim protection and ensure effective prosecution, even in cases of sexual violence that only become known years later, as stated by the chairwoman of the Conference of Justice Ministers to the German Press Agency.

Gallina acknowledged that the reform of sexual criminal law ten years ago brought significant progress. However, it also led to certain particularly serious offenses expiring after only five years.

Short Limitation Periods Undermine Protection

This applies especially to rapes where the perpetrator exploits the victim’s inability to form or express a will against the act. “Not every victim reports such an act promptly due to fear, shame, or traumatization,” Gallina explained. “The comparatively short statute of limitations can mean that the offense can no longer be prosecuted, which undermines the protective purpose of the law.”

Her authority cited a case handled by the Hamburg public prosecutor’s office last year as an example: The accused was charged with 67 acts of sexual abuse against his wife, who was unable to form or express her will.

“Under the old law, these acts, as they involved penetration of the victim’s body, would have been classified as crimes with a statute of limitations of 20 years,” a spokesperson for the authority said. After the reform of sexual criminal law, they became misdemeanors with a statute of limitations of only five years. “Therefore, 65 of the 67 offenses had to be dropped due to the statute of limitations, despite extensive evidence.”

Higher Penalties to Bring Longer Limitation Periods

To prevent this from happening in the future, Gallina will present a draft resolution at the Conference of Justice Ministers in June in Hamburg. The proposal aims to amend Section 177 of the Criminal Code, which regulates sexual assault, sexual coercion, and rape. By increasing the penalty framework, she also seeks to extend the statute of limitations to ten years.

The Senator also stated that she could imagine creating a separate offense for such special cases where the helplessness of the victims is exploited.

Context: Rising Numbers and Calls for Reform

This initiative comes amidst a broader discussion on sexual offenses. Recent headlines indicate a significant rise in reported rapes in 2025, according to crime statistics. The EU Parliament has also called for a unified definition of rape, highlighting the international focus on this issue. Debates continue on whether Germany is a “perpetrator’s paradise” due to perceived loopholes in its legal framework.

The proposed changes by Senator Gallina aim to address these concerns by ensuring that justice can be served even when victims come forward after a significant delay, providing them with more time to process trauma and report crimes.

The Conference of Justice Ministers in June will be a crucial forum for discussing these proposals and potentially paving the way for significant reforms in Germany’s sexual criminal law.
