38-Year-Old Faces Charges in Hamburg Regional Court
Hamburg, September 29 – A 38-year-old man from Hamburg-Schnelsen has been on trial since Tuesday at the Hamburg Regional Court for attempted sexual abuse and possession of child pornographic material. The alleged incident occurred four years ago in a youth residence in Hamburg-Eidelstedt.
Allegations of Intrusion and Abuse in Youth Residence
According to the indictment, the defendant allegedly entered a youth residence in Hamburg-Eidelstedt through a basement window in the middle of the night four years ago. His alleged intent was to touch and photograph sleeping children and adolescents in their intimate areas.
The prosecution states that the 38-year-old first sat on the bed of a 14-year-old girl, attempting to pull back her blanket and touch her. Subsequently, he allegedly tried to abuse two other children, aged seven and nine.
Children Awakened, Suspect Fled
All the children were awakened by the incidents and called for the group supervisor. Following this, the man reportedly left the room and fled the building. The public prosecutor is convinced that the now-indicted 38-year-old is the perpetrator.
Discovery of Child Pornography on Suspect’s Phone
A search of the suspect’s apartment in Schnelsen by police led to the discovery of 132 images depicting the sexual abuse of children on his mobile phone, according to the public prosecutor’s office.
Additionally, the defendant is accused of receiving child pornography via the messaging services WhatsApp and Telegram in various group chats between June and October 2022, and in three instances, sending such material himself.
Offer of Leniency for a Confession
On Tuesday, the presiding judge informed the defendant that his sentence would be significantly milder if he confessed and spared the children from the Eidelstedt youth residence from having to testify in court. However, the 38-year-old has remained silent thus far.
Broader Context: Justice System Challenges in Hamburg
This trial takes place amidst concerns raised by the Hamburg Judges’ Association, which believes the functionality of the justice system is at risk. The Senate, however, points to a decreasing number of open investigative proceedings.
