Berlin, July 3, 2026 – Berlin residents who suspect they are paying excessive rent can now report it to their relevant district office online. This new digital service, accessible through the official Berlin Service Portal, aims to streamline and accelerate the process, according to the Senate Department for Urban Development, Construction and Housing.
New Online Service for Tenant Protection
Senator for Construction Christian Gaebler (SPD) emphasized that the ability to report excessive rent online is a significant step towards strengthening tenant protection in the city. The initiative is designed to empower tenants to take action against unfair rental practices more easily.
Checking Your Rent: The First Step
Before filing a report, tenants are advised to check their rent against the local comparative rent using the Berlin Rent Index. A dedicated search service for this purpose is also available online. If the rent exceeds the local comparative rent by more than 20 percent, it can be reported to the district office for review, as such a discrepancy constitutes an administrative offense.
Consequences of Excessive Rent
Reporting excessive rent can lead to several outcomes for landlords. Under certain circumstances, a fine may be imposed. Furthermore, the tenant may be entitled to a refund of the excess rent paid. If the rent surpasses the legal limit by more than 50 percent, it raises suspicion of “exorbitant rents,” which could be considered a criminal offense.
The Reporting Process and Follow-Up
Once a digital report is submitted, the district office will contact the tenant to clarify the situation and determine if an excessive rent increase has occurred. This may involve requesting additional information and documentation from the tenant. If the initial suspicions are confirmed after review, the district office can initiate administrative proceedings.
Support from the Rent Review Board
The Berlin Senate established the Rent Review Office in March 2025 to address cases of excessive rents. This body has consistently identified instances where rents were significantly higher than the local comparative rent. The Rent Review Office serves as another valuable resource for tenants, offering advice through phone consultations or in-person meetings.
This new online reporting system, combined with existing resources like the Berlin Rent Index and the Rent Review Board, provides a comprehensive framework for tenants to protect themselves against unfair rental practices in the capital.
