Hamburg, June 13 – The Hamburg Parliament is scheduled to vote today on a new regulation that would require all applicants for public sector jobs in the city to undergo a security check by the intelligence service (Verfassungsschutz). The so-called ‘Regelanfrage’ or standard inquiry, would involve the intelligence service checking whether they hold any information on an applicant. According to the Senate, the goal is to ensure the integrity of the public service. Sören Schumacher, an SPD Member of Parliament, emphasized, “We must identify enemies of the constitution in the public service – therefore, the inquiry with the intelligence service is the right way to protect us all.”

Opposition from Youth Wings and Trade Unions

The proposal has drawn significant criticism from various groups, including the Jusos (Young Socialists in the SPD), the Green Youth, and several trade unions. Their primary concern revolves around the potential for political misuse of such data. Critics argue that if, for example, the AfD – classified as a proven right-wing extremist party in Saxony-Anhalt – were to control the Interior Ministry there, it could feed information into a central register, directly influencing hiring processes even in Hamburg.

Olaf Schwede from the German Trade Union Confederation (DGB) warned that such measures could deter socially engaged young people from applying for public sector jobs, fearing unwarranted scrutiny or misinterpretation of their activities.

Clarifications and Lingering Questions

Hamburg lawyer Sarah Geiger clarified that the standard inquiry does not prohibit civil servants from criticizing the state, provided it is done within the framework of the Basic Law. Protests, she stated, explicitly remain permitted. However, the “Hamburg Alliance against Professional Bans” still criticizes the lack of clarity regarding what information the intelligence service collects and how it is shared.
