Hamburg, September 14 – The city of Hamburg is set to implement significantly stricter rules for public procurement, aiming to further prevent wage dumping and strengthen collective bargaining agreements. The ruling coalition of the Social Democratic Party (SPD) and the Greens successfully passed a motion in the Bürgerschaft this week, tightening existing regulations.
The reform, initially proposed by the Senate in late March, stipulated that public contracts would only be awarded to companies adhering to industry-specific collective wage agreements. The current amendment by the government factions further sharpens these provisions.
Lowered Thresholds and Increased Controls
A key change involves reducing the financial threshold for requiring fair wage payments. Previously, this applied to contracts exceeding 500,000 euros. Under the new regulations, companies bidding on public contracts worth 250,000 euros or more will be required to demonstrate adherence to collective wage agreements for their employees.
Furthermore, the ability to monitor compliance with these fair wage standards will be enhanced. Authorities will now be empowered to conduct random checks without requiring specific suspicion, making it easier to identify and address potential violations.
Political Support and Rationale
Milan Pein of the SPD emphasized the importance of the new rules, stating, “We ensure that public investments strengthen good work and that companies that adhere to the rules are not disadvantaged.” The approval of the red-green motion in the Bürgerschaft was widely anticipated and considered certain.
The city of Hamburg annually issues contracts for goods and services exceeding 340 million euros, according to the Finance Authority. This figure does not include significantly larger sums allocated for investments in infrastructure, such as roads and schools. Dennis Döscher, a Green Party member of the Bürgerschaft, highlighted that Hamburg is investing an unprecedented amount in the coming years, particularly in climate protection and the expansion of bus and rail networks.
